Re: Implementation of an Administrative Penalty System (APS) for Traffic By-law Infractions in Whitby

Andre Gratton provided a presentation regarding the implementation of an Administrative Penalty System (APS) to encourage compliance with the Town’s Traffic By-law. Highlights of the presentation included:

  • an overview of the APS model and its benefits;
  • the process for issuing and disputing parking ticket notices;
  • updates to the Traffic By-law aimed at improving bicycle lane safety;
  • introduction of a tiered parking fine structure;
  • expanded enforcement options including the ability to serve Penalty Notices by mail; and,
  • accepting witness statements for parking infractions.

A question and answer period ensued regarding:

  • criteria for issuing parking tickets;
  • whether residents were permitted to submit photographs of parking infractions to the Enforcement Services Division for by-law enforcement purposes;
  • high priority zones for parking enforcement, such as school zones; and,
  • the process for notifying the Ministry of Transportation, Registrar of Motor Vehicles for the purpose of denying renewal of a vehicle permit or the issuance of new vehicle licence plates due to failure to pay a Penalty Notice.

There were no delegations.

It was the consensus of the Committee to hear Item 8, Council Update, at this time.

David Johnston provided an update regarding the Committee’s feedback on potential curb cut locations, active transportation network gaps, and trail opportunities. Mr. Johnston stated that the Committee's view on key active transportation network gaps were consistent with those identified in the Active Transportation Plan, Appendix B priorities.

Councillor Mulcahy provided an update regarding:

  • the Town of Whitby would receive $5.4 million through Ontario's Building Faster Fund for meeting 80 percent of its annual housing target in 2023;
  • the Town’s Emergency Preparedness and Climate Change Survey;
  • a new public art installation at the Brookfield Residential Station No. 3 condominium building, honouring the building's history and Molly, the Fire Safety Education Dog;
  • the November 18, 2024 Special Council Meeting to provide Council education and training regarding the 2025 Budget; and,
  • the November 19, 2024 Public Meeting to obtain public feedback on the proposed 2025 Strong Mayor's Budget.

It was the consensus of the Committee to hear Item 6.1, Potential Curb Cut Locations and Active Transportation Network Gaps, at this time.
